Plaintiff Navarette, represented by experienced attorney Danielle K Wakefield, sues Narconon Fresh Start, et al, for Breach of Contract, Violations of California CIVIL CODE § 1770 et seq, Fraud - Intentional Concealment, Fraud - Misrepresentation, Conversion, and Unfair Competition (BUS & PROF CODE § 17200) concerning his payment for, and contract with, defendants for his daughter's addiction and mental health co-disorders. There are many new and familiar issues laid out in this complaint by yet another parent deceived while trying to help their loved one. Well worth reading the lawsuit document in full. Plaintiff Kelly was admitted to Sunshine Summit Lodge, Narconon's Warner Springs, California facility, in or about April 2013, for which they paid $33,000. Dan Carmichael, the intake counselor, and Defendants had promised Plaintiffs that Kelly would undergo a medically supervised detoxification, be "well taken care of," and that Narconon had a high success rate. They also promised that KELLY would have access to specific treatments to help him get through detoxification and substance abuse treatment. Additional misrepresentations were made regarding the facility, as well.

Unsubstantiated: Complainant alleged improperly licensed and unqualified staff, late notification of no refund policy, poor supervision and safety of sauna, staff spoke disrespectfully to client, lack of CPR certifications by staff members, facility dirty and in disrepair, false internet advertising of 78% success rate. Substantiated: Water damage observed on kitchen ceiling, leaking hot water heater, fire extinguisher missing staff initials and date of monthly safety inspections, window screen torn in staff room, shower head in male resident's room held together by tape.
This former client of Narconon's Sunshine Summit Lodge in Warner Springs, California was not only addicted to drugs, but also had the added complication of Fibromyalgia. She was court ordered into a drug rehab program and chose Narconon because their program claimed to get rid of drug cravings and improve Fibromyalgia; because it was "a holistic treatment program that would teach me life skills"; and because quality of food was important to her because of the Fibromyalgia, and Narconon led her to believe the food would be healthy. Knowing what she knows now, she would not make the same choice today.
As the result of an unannounced state inspection, Narconon Huntington Harbor was cited for the following deficiencies: Failure to conduct annual TB tests on all employees, grease build-up on kitchen cabinets, dirty stove and microwave, 20 knives and gardening tools left unsecured, clean-up required for car parts, doors and equipment, disorganized yard.
Mother initially filed complaint because she was concerned about her daughter's welfare at Narconon Huntington Harbor. However, according to the mother, the daughter wanted to remain at the facility. The mother chose to decline filing a formal complaint and asked for license verification, only.
