Summary:

This complaint is for: 1. Breach of Contract; 2. Unjust Enrichment; 3. Fraud – Intentional Concealment; 4. Fraud – Negligent Misrepresentation; 5. Conversion; and 6. Unfair Competition (Business and Professions Code §17200 et seq.).

Plaintiff Kelly was admitted to Sunshine Summit Lodge, Narconon’s Warner Springs, California facility, in or about April 2013, for which they paid $33,000. Dan Carmichael, the intake counselor, and Defendants had promised Plaintiffs that Kelly would undergo a medically supervised detoxification, be “well taken care of,” and that Narconon had a high success rate. They also promised that KELLY would have access to specific treatments to help him get through detoxification and substance abuse treatment. Additional misrepresentations were made regarding the facility, as well.

Additional Info:

Kelly was sent to Huntington Harbor House for 3 days for "medical" detoxification. At no time was Kelly monitored by qualified medical personnel. Kelly found the detox facility to be "dirty, smelling of mildew, dilapidated, and generally unsanitary." It was later discovered that the 'faculty' at the detox facility was not licensed in any sort of clinical drug rehabilitation.

After the "medical detox" at Huntington Harbor House, Kelly was transferred to Sunshine Summit Lodge, where he was repeatedly given large unhealthy doses of Niacin, made to sit in a sauna for up to 5 hours per day, and "introduced to and indoctrinated into the NARCONON treatment program based upon the teachings of Scientology." Kelly left the facility after 21 days of mistreatment. Voiculescu repeatedly requested a refund for the unused portion of the payment from Bruce Haddrill, Narconon's attorney, but Narconon and Haddrill refused.
